Swiggle, Inc., with a principal place of business at 701A East Las Olas Blvd, Fort Lauderdale FL 33301, is the owner and operator of the Swiggle mobile application and coupon giveaways and game promotions (“Swiggle”). You must agree to these Promo Rules and our Terms of Use. The terms used in these Promo Rules have the same meaning as assigned to those terms in the Terms of Use. The game promotions related to grand prizes (“Promotions”) are subject to all applicable national, federal, state, and local laws and regulations. Receiving a grand prize is contingent upon fulfilling the requirements set forth in this Agreement.

NO PURCHASE OR PAYMENT IS NECESSARY TO PARTICIPATE IN THIS PROMOTION OR TO WIN GRAND PRIZES. SWIGGLE DOES NOT OFFER ANY REAL MONEY GAMING.

1. Eligibility

The Promotions are open to (i) natural persons, (ii) who are at least eighteen (18) years old or the minimum age in their jurisdiction at the time of entry, whichever is greater, and (iii) are the owner of an account on the App. The Promotions are not open to any person (i) living in a jurisdiction where the Services are illegal, (ii) living outside of the United States, (iii) living in Nebraska, North Carolina, Ohio, Pennsylvania, or Rhode Island, (iv) on the Treasury Department’s list of Specially Designated Nationals, or (v) that is or is an immediate family member of an employee, distributor, associate, concessionary, or other agent of Swiggle.

2. Promotional Period

The termination date of each Promotion is prominently displayed on the App on the page associated with each individual grand prize. Our servers are the official time keeping device of the Promotions. Each grand prize is a separate Promotion. Swiggle reserves the right to cancel, pause, modify or suspend any part of or all the Promotions with immediate effect owing to events or circumstances outside of its reasonable control. Any event or circumstance impairing the proper functioning or integrity of the Promotions will be determined by Swiggle, and corrective action will be taken by Swiggle in its sole discretion.

3. Coupons

You may receive coupons by spinning the wheel and either (1) winning a coupon, or (2) earning points which may be redeemed for coupons.

4. Grand Prizes

Each time you use a coupon, you will receive one entry to a grand prize game of your choice. You must select the grand prize game of your choice and spin the wheel to reveal whether you are a winner. The value of grand prizes varies, but at all times is less than five thousand dollars ($5,000). Swiggle’s decision on how to administer and manage the game and award grand prizes is final and binding. Prize winners will be notified by electronic display on the App. Violation of our Terms of Use makes any winnings null and void. To redeem your winnings, you must provide all necessary information reasonably requested by Swiggle.

5. Odds

The odds of winning any particular coupon or grand prize vary. Swiggle reserves the right to adjust the odds of winning the Promotions at any time.

6. Taxes and Fees

Swiggle is not responsible for any taxes, bank charges, and transaction fees associated with any winnings. You are solely responsible for any incurring taxes, bank charges, or transaction fees associated with the winnings.

7. Verification

Before you redeem any winnings, Swiggle may require you to provide certain verification documentation and information and sign certain forms within seven (7) days. If you fail to provide the requested documentation or information or sign the required forms in a timely manner, or if we determine that you have violated our Terms of Use, you will forfeit your winnings, and we may suspend or terminate your account. Swiggle will not be held responsible for any delays caused whatsoever.

8. Release

You will hold Swiggle and our employees, clients, subsidiaries, affiliated companies, agents, media partners, officers, directors, content providers, and related parties not accountable for, and you will indemnify same from, any and all costs, expenses, liabilities and damages that may arise as a result of (i) your acceptance of any winnings, (ii) your use of any and all materials on the App, (iii) your participation in the Promotions, (iv) your activity in connection with any Prizes, and (v) your other uses of the Services.

9. Publicity

By redeeming any winnings, you grant Swiggle the right to use your name, image, opinions, comments, voice, and likeness for advertising purposes in any media, worldwide, without notice or further consideration, except where prohibited by law.

10. Damages and Disqualification

Swiggle may actively seek damages from any person cheating or acting in bad faith to undermine the legitimate function of the Promotions to the fullest extent permitted by law. You may be disqualified from the Promotions if you violate our Terms of Use.
